These Terms of Use ("Terms") are an agreement between you and EC3 LLC ("EC3", "we", "us"), a limited liability company organized in the Commonwealth of Virginia, USA. They cover the mobile application EC3 LLC distributes as Alet (including test versions released under an earlier name) and its web version (together, the "App"), including its AI features and any updates we release.
By installing, opening, or using the App you accept these Terms. If you do not agree, do not use the App. Our Privacy Policy explains what information the App handles; it is part of these Terms.
You must be at least 13 years old to use the App. If you are under 18, a parent or legal guardian must have agreed to these Terms on your behalf and must make any purchase. The App is not directed to children under 13, and we do not knowingly collect information from them.
The App is a personal organizer: you capture tasks, lists, events and notes, and the App sorts and reminds. Everything you enter is stored on your own device. There are no accounts and no server-side copy of your tasks. Some information does leave your device, including: the text you ask the AI features to sort (it is sent to our AI provider), feedback you choose to send us, a once-a-day visit count you can switch off, and, on copies that sell the subscription, a check of your subscription with RevenueCat, the company that runs our subscriptions. AI sorting stays off until you agree when the App first asks, and you can turn it off any time in Settings (Smart sorting (AI)). The Privacy Policy describes all of it in detail.
You own what you put in the App. Because it lives on your device, you are responsible for keeping it safe: use the App's Download my data export to make backups, especially before changing phones or uninstalling. We do not hold a copy and cannot recover data that is lost from your device.
You agree not to use the App to store or send anything unlawful. When you use the AI features, you are choosing to have the text you entered processed by our AI provider as described in the Privacy Policy; please do not put anything in that text that you do not want processed by an AI service.
The App's AI sorting is automated. It can misread what you meant, file something in the wrong place, or pick a wrong time. Always check what it did. The App is not a medical, legal, financial or safety service and gives no advice of those kinds.
Reminders are scheduled on your device by your phone's operating system. Phones delay, silence and drop notifications for reasons outside our control (battery settings, Do Not Disturb, updates, a phone that is off). Do not rely on the App as your only reminder for medication, appointments, care of another person, or anything where a missed reminder could cause harm.
To keep costs and abuse under control, the AI features and the feedback door have reasonable usage limits (for example a number of AI sorts per day and per month per device). When a limit is reached, that feature pauses and the App tells you it did not run; capture and everything else keep working.
Eligible new subscribers can start a free trial through the store. The available offer and eligibility are shown before you confirm. You start the trial in the App, and the store asks you to confirm. Starting the trial starts a subscription: it becomes a paid plan when the trial ends unless you cancel before then. Plans are monthly or yearly subscriptions, bought through the store. The price, the trial length and the renewal period are shown in the App and in the store before you start. The free trial is available once per Apple or Google account, and only to an account that has not subscribed to the App before. Your plan belongs to that store account, not to one phone: you can use it on the phones and tablets signed in to that account (if one does not unlock on its own, tap Restore purchases there). The App has no accounts of its own, so a plan bought through Google Play does not unlock the App on an iPhone, and a plan bought through the App Store does not unlock it on Android. Without an active trial or plan, the App is read-only (see below).
Automatic renewal. A subscription renews automatically at the end of each billing period at your applicable subscription price, unless canceled. Price changes are subject to the store's notification and consent requirements and applicable law. You can cancel at any time in your Apple or Google subscription settings (iPhone: Settings › your name › Subscriptions; Android: Play Store › your profile › Payments & subscriptions › Subscriptions). While you have a subscription, Manage subscription in the App (Settings › Subscription) opens that store page for you. For Google Play, cancel before the trial ends to avoid the first subscription charge. For Apple, cancel at least 24 hours before the trial ends. Cancellation normally stops future renewal charges; refunds and any earlier end to access depend on the store's policy and applicable law. Payment, billing, refunds and cancellation are handled by the store you bought from, under its terms and refund policy; we do not see or store your payment details.
Restore purchases. If you subscribed on another phone or tablet, or you reinstalled the App, tap Restore purchases (in Settings › Subscription, and on the screen where you subscribe). The App asks the store for the subscription on the account you are signed in to, and unlocks if it finds one.
If a payment fails. If the store gives you a grace period to fix a renewal payment that did not go through, the App keeps working during it. After that, the App is read-only until the payment goes through or you subscribe again.
When a plan ends (you cancel and the paid period runs out, a failed payment is not fixed, or a purchase is refunded), the App becomes read-only: you can still open it, see everything you entered, and export it, but you cannot add, edit, delete or check things off until a plan is active again. Nothing is deleted.
Prices may change. Before a higher price applies to your subscription, the store tells you (see "Automatic renewal" above), and you can cancel before it takes effect.
Free access. We may give some people free access, for example testers. It lasts until the date we tell you, if we give one. When it ends, the App is read-only unless you start a plan.
Testing programs. A test copy that does not sell the subscription is free and needs no plan (for example, the web version, and the iPhone app until subscriptions come to it). A copy from Google Play testing works like a store copy (a free trial if you're eligible, then a plan) unless we have given you free access. If we have added you as a license tester, purchases are Google's test purchases and nothing is charged. Once the iPhone app sells subscriptions, a copy from Apple's TestFlight works like a store copy too, except that purchases there are Apple's test purchases: nothing is charged, and a test subscription stops renewing on its own within about a week. Test builds change often, and features, data formats and limits may change or reset between builds. The web version is a test build.
We grant you a personal, limited, non-exclusive, non-transferable license to install and use the App on devices you own or control, for your own personal use, under these Terms. The App is licensed, not sold. Except where the law allows it, you may not copy, modify, sell, rent, distribute, reverse engineer or decompile the App, remove any notices from it, or work around its limits or its subscription controls.
If you send feedback through the App, we may use it to improve the App without owing you anything for it. A feedback note can carry the technical details of an error the App hit. The App tells you before you send, lets you read exactly what would go, and lets you leave them out. We may limit how many notes one device can send in a day.
The App is distributed through the Apple App Store and Google Play, and its AI features use OpenAI. Your use of those services is also subject to their terms. We are not responsible for them. Subscriptions are bought through the store; RevenueCat keeps the subscription records for us, as the Privacy Policy describes.
The App is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including of merchantability, fitness for a particular purpose and non-infringement, or that the App will be error-free, uninterrupted, or that its AI results or reminders will be accurate or timely. Some jurisdictions do not allow the exclusion of implied warranties; in those, the exclusion applies only as far as the law permits.
To the fullest extent the law allows, EC3 LLC and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits, missed appointments or missed reminders, arising out of or relating to the App or these Terms, even if we were told such damages were possible. Our total liability for any claim relating to the App is limited to the amount you paid for the App through the store in the twelve months before the claim (or fifty US dollars if you paid nothing). Some jurisdictions do not allow these limits; in those, they apply only as far as the law permits. Nothing in these Terms limits liability that cannot be limited by law.
You can stop using the App at any time by uninstalling it (that removes the data stored on your device — export first if you want to keep it). We may suspend or end your access to the AI features or the feedback door if you abuse them (for example by flooding them or trying to work around their limits), and we may end or change the App with reasonable notice. If we discontinue the App, the export remains available for a reasonable time so you can take your data with you.
We may update these Terms. When we do, we will revise the effective date above and, for material changes, post the updated Terms at getalet.app/terms and, where we reasonably can, tell you in the App. Using the App after a change means you accept the updated Terms.
These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-law rules. Before bringing a claim, please write to us at support@getalet.app and give us thirty days to try to resolve it with you. Any claim that is not resolved must be brought in the state courts located in Chesterfield County, Virginia, or the United States District Court for the Eastern District of Virginia, Richmond Division, and you and we each consent to their jurisdiction — except that either of us may bring a qualifying claim in small-claims court. If you are a consumer in a place whose law gives you the right to sue where you live, nothing here takes that right away.
If you got the App from the Apple App Store, these additional terms apply, and Apple requires us to say them: these Terms are between you and EC3 LLC only, not Apple, and EC3 LLC alone is responsible for the App and its content. Your license is limited to use of the App on Apple-branded products you own or control, as permitted by the App Store's Usage Rules, except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing. EC3 LLC, not Apple, is responsible for maintenance and support of the App; Apple has no obligation to furnish any. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App to you; to the maximum extent permitted by law Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are EC3 LLC's responsibility. EC3 LLC, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws. If a third party claims the App infringes its intellectual property rights, EC3 LLC, not Apple, is responsible for the investigation, defense, settlement and discharge of that claim. You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
These Terms and the Privacy Policy are the whole agreement between you and us about the App. If any part is found unenforceable, the rest still applies. If we do not enforce a term, that is not a waiver of it. You may not transfer these Terms; we may transfer them to a successor of our business.
